Changes to NDIS Commission Powers Over NDIS Providers: Key Updates

Minister for the National Disability Insurance Scheme and Government Services, the Hon. Bill Shorten MP, recently announced new legislative reforms known as the “Getting it Back on Track Bill.” This bill aims to significantly improve protections for NDIS participants and workers, improving the quality and safety standards within the NDIS.

A central aspect of this proposed law is a substantial increase in provider penalties. Where a participant is harmed under a provider’s care, penalties will now exceed $15 million—an increase from the previous maximum of $400,000. This new maximum aligns with existing Work Health and Safety (WHS) penalties for harm to workers, addressing a long-standing disparity in the value placed on participant and worker safety.

For the first time, the NDIS Quality and Safeguards Commission can refer providers for criminal prosecution. This authority allows the Commission to pursue legal action in cases of severe non-compliance, such as serious failures to meet registration requirements. The NDIS aims to better protect participants and create a safer, more accountable support environment through these strengthened compliance measures.
